The British broadcaster tried to subpoena Trump’s adult kids who were with him on 1/6. They were also granted access to Trump’s business records by the judge, only for the president to amend his lawsuit to remove the claim that his business had been harmed; thus, he did not have to turn over his business records.
The BBC has also tried to get the phone records for every phone that Trump used on 1/6 beyond the White House switchboard. The 1/6 Committee was limited to only White House phone records, which were incomplete.
What Trump expected to be another step in his media-bullying cash grab turned into a legal rock fight, and now a judge has ordered Trump to sit for a deposition by December 11.
Trump Has Been Trying To Get Out Of Testifying
Trump has been trying to get out of testifying for months, which is odd behavior for someone who brought the lawsuit and claimed that he was defamed.
Last week, Bloomberg reported that the judge threatened Trump wth sanctions unless he testified:
“The court has admonished plaintiff for his lack of participation to no avail,” US Magistrate Judge Enjolique A. Lett said in a brief order in Miami. “Going forward, the court expects strict compliance with its order, the failure of which will lead to sanctions.”
Lett made the comment in response to a BBC motion to compel Trump to answer their questions in a deposition — which he has tried to postpone, including a session scheduled for Friday, “due to other matters of national importance.” The judge scheduled a hearing by Oct. 22 on the issue, according to the order.
The BBC wants former special counsel Jack Smith to testify. Trump is trying to block Smith’s testimony.
However, before the question of Smith’s testimony can be settled, the judge ordered Trump to be deposed by December 11.

The order from U.S. Magistrate Judge Enjoliqué Lett came as lawyers for the British broadcaster complained that Trump had delayed his appearance. Charles Tobin, the attorney for the BBC, said that with two months left in the discovery period, “we still haven’t been able to depose the plaintiff.”
Lett said Trump must sit for a deposition by Dec. 11, or face sanctions up to dismissal of his lawsuit -– unless the discovery period was extended past Dec. 18.
The lawsuit would never have happened if Trump hadn’t filed it. There was no defamation. The BBC did not edit the footage they used or do anything defamatory. The lawsuit was part of Trump’s effort to rewrite history and erase his role in inciting the 1/6 attack.
Trump is drunk with delusion about his own power, but Trump has no power or authority over the BBC. The other media outlets paid up because they either needed the administration’s approval or feared retaliation.
The BBC has none of those concerns. Trump has no authority and can do nothing to the BBC, so the broadcaster can follow the First Amendment playbook can fight the president.
Trump is going to lose this lawsuit, and his deposition could be devastating if it ever becomes public.
